TERMS AND CONDITIONS FOR DJ SERVICES

These terms and conditions serve as a contract or agreement between the person whose name appears on this order, herein after referred to as the Purchaser and Robert Quesada herein after referred to as DJ Mister Q.

By accepting these terms and conditions, the purchaser agrees to abide and follow all the covenants contained herein.

Purchaser agrees to procure access for DJ Mister Q to the event facility at least two hours before the DJ services start time to set up and test equipment.

Purchaser agrees to place DJ Mister Q and all equipment under a covered hard roof, not a tent, at all times. All equipment, including DJ Mister Q must be placed at a minimum distance of six feet from the edge of the roof.
The Purchaser shall provide a minimum of one nearby (not further than 6 feet) electrical outlet (minimum20Amps). Purchaser agrees to provide any protection necessary to keep the DJ equipment from being damaged.
DJ Mister Q is an independent contractor and not an employee of the Purchaser.
DJ Mister Q uses and maintains equipment of the highest quality, however in the unlikely event that time is lost due to DJ Mister Q equipment malfunction, DJ Mister Q will refund the portion of the total amount corresponding to the time lost. This is the extent of DJ Mister Q’s liability.
The Purchaser acknowledges that DJ Mister Q will be the only DJ hired to play at the event and no other DJ, whether paid or not, will be allowed to play at the event.

Hora Loca, Mariachis or any Live act must have their own sound system and music, or, make arrangements with DJ Mister Q at least thirty (30) days in advance of the performance date for any additional setup. Any other music not in DJ Mister Q’s music library has to be submitted to DJ Mister Q at least thirty (30) days before the event. If the music is not provided, DJ Mister Q will choose the music. Purchaser must provide DJ Mister Q with a list of any requested music no later than 15 days prior to the event.

Purchaser agrees to provide DJ Mister Q with a song list of the music that Purchaser wants played at the event at least 15 days before the event. DJ Mister Q does not guarantee that any songs requested by Purchaser less than 15 days before the event or at the event itself will be played.
The Purchaser acknowledges that DJ Mister Q may need to use an associate disc jockey as a substitute for should a situation that dictates this arises (e.g., emergency, etc.).
DJ Mister Q carries liability insurance however the Purchaser is responsible for damages resulting from the conduct of all persons attending the event or working at the event, including any damage to DJ Mister Q’s equipment.
If the Purchaser cancels this order/agreement less than 30 days prior to the scheduled performance, then the Purchaser will be liable for the entire balance. If the Purchaser cancels this order/agreement more than 30 days prior to the scheduled performance date, then the Purchaser shall forfeit all monies paid including but not limited to the date reservation fee.
The Purchaser will be responsible for any valet or parking fees, including tips, incurred by DJ Mister Q as a result of executing his performance.
The Purchaser shall be liable for any and all costs, including collection fees resulting in an “insufficient funds” check and reasonable attorney’s fees and costs incurred in enforcing this contract.

Purchaser agrees that all the information contained in the order/agreement is correct and that any change or deviation constitutes a breach of contract by Purchaser and cancellation of this order/contract by DJ Mister Q without a refund of all monies paid. No part of this order/agreement may be changed or modified without the prior written consent of both parties. This order/contract shall be rendered void unless the balance of this order is not received one week before the event.
